This Waiver and Disclaimer (“Agreement”) is entered into by and between the purchaser
(“Customer,” “You,” or “Your”) and Turnkey Exteriors, LLC and AF Tech USA, Ltd.,
collectively dba HausShieldPro powered by AF Tech (“Company,” “We,” or “Us”), with respect
to the purchase, use, and application of the EmberSafe home protection product (“Product”).
1. EMERGENCY COMPLIANCE REQUIREMENT
You must strictly follow all evacuation orders from federal, state, or local authorities. Do not
remain on-site to apply the Product if doing so jeopardizes your safety or the safety of others.
Personal safety must take precedence over property protection.
2. PRODUCT USE AND APPLICATION
Apply EmberSafe only when safe to do so and in accordance with all labeled instructions. Do not
apply in hazardous conditions or during active fire exposure. For complete guidelines, refer to

3. NO GUARANTEE OF PROTECTION
The Product is designed to reduce the risk of wildfire damage, but does not ensure complete
protection from fire, embers, smoke, or heat. Its effectiveness is impacted by many variables,
including application technique, environmental conditions, fire intensity, and property type.
4. ASSUMPTION OF RISK
By purchasing and/or using the Product, you assume full responsibility for all associated risks,
including personal injury, property damage, and potential ineffectiveness of the Product. You
release the Company from any liability for damages resulting from use, nonuse, or misuse.
5. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Company shall not be liable for any indirect,
incidental, special, punitive, or consequential damages, including but not limited to property loss,
personal injury, or death—even if such loss arises out of the proper use of the Product.
6. INDEMNIFICATIONYou agree to indemnify, defend, and hold harmless the Company and its affiliates, employees,
contractors, and agents from any claims, damages, costs, or liabilities (including attorneys’ fees)
resulting from your use, misuse, or failure to follow instructions for the Product.
7. SERVICE AND PRODUCT LIMITATIONS
While we strive to provide high-performance products and services, their effectiveness may be
impacted by external conditions beyond our control. The Company does not guarantee that
fires or other hazards will be prevented or mitigated by the Product.
8. WARRANTY DISCLAIMER
Unless otherwise explicitly stated in writing, the Product is provided “as is” and without
warranties of any kind, either express or implied, including warranties of merchantability,
fitness for a particular purpose, and non-infringement. Use outside of published guidelines voids
any implied warranties.
9. PROFESSIONAL ADVICE DISCLAIMER
All materials and instructions provided by the Company are for general informational purposes
only and do not substitute for advice from certified fire safety professionals or local authorities.
10. REGULATORY COMPLIANCE
While we aim for regulatory alignment, it is the Customer’s responsibility to ensure full
compliance with all applicable laws, codes, and ordinances. Always consult local fire
departments and relevant agencies to confirm your obligations.
11. MODIFICATIONS AND UPDATES
The Company reserves the right to update Product specifications, usage guidelines, or policies at
any time without notice. It is your responsibility to stay informed of the most current instructions
and safety practices.
12. SHIPPING AND DELIVERY
Products are shipped FOB (Free on Board) from our fulfillment center. Risk of loss or damage
transfers to the Customer upon delivery to the carrier. The Company is not liable for delays
caused by carriers, natural disasters, or other events beyond our control. It is the Customer’s
responsibility to inspect all shipments upon delivery and report any damage within 48 hours.
13. RETURNS AND REFUNDS
Due to the safety-critical nature of the Product, returns are only accepted for unopened and
unused products within 15 days of delivery, subject to a 20% restocking fee. The Companyreserves the right to deny returns that do not meet these conditions. All shipping costs for
returned items are the responsibility of the Customer.
14. INTELLECTUAL PROPERTY
All trademarks, logos, brand names, and proprietary formulations associated with the Product are
the intellectual property of the Company or its licensors. No rights or licenses are granted to the
Customer by virtue of purchase or use. Unauthorized use, reproduction, or distribution is strictly
prohibited.
15. EXPORT COMPLIANCE
The Customer agrees to comply with all applicable U.S. export and re-export control laws and
regulations. You may not export or transfer the Product to any country, individual, or entity
subject to U.S. sanctions or export restrictions.
16. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of
Colorado, without regard to conflict of laws principles. Any legal action arising under this
Agreement shall be brought exclusively in the courts located in Denver County, Colorado.
17. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties regarding the Product
and supersedes all prior communications, representations, or agreements, whether oral or written.
18. ACKNOWLEDGMENT AND ACCEPTANCE
By purchasing and/or using EmberSafe, you confirm that:
• You have read, understood, and voluntarily accepted this Waiver and Disclaimer.
• You agree to follow all safety guidelines and official directives.
• You accept full responsibility for any outcomes resulting from the use of the Product.
This product is currently only available for delivery in Colorado.
